Judgment for plaintiff in a suit between Timothy Gabry, vendue master, plaintiff, against the city clerk and city marshal, defendants, to enjoin them from selling certain class of property by public auction; in this case it was held that all sales of property surrendered for the benefit of creditors should be by the provincial secretary, or his deputy.
